A case reported under POCSO act and murder
(Punjab Academy of Forensic Medicine and Toxicology, 2018) Manoj Kumar Pathak; Shashank Shekhar Jha; Srishti Rai
Introduction: The overall conviction rate of cases registered under POCSO rests at a meagre 7-16%. According to the NCRB data for 2016, incidents of rape of children have increased by over 82% from 2015. Material and Method: On 20/09/2018, a case of 12 year old girl child victim was brought to our department for post-mortem examination. FIR was lodged under section 302 IPC, 354B IPC along with POCSO Act 2012, section 7, 8. Findings (Result): As per Post-mortem examination, it was opined that, the cause of death of the victim was (both primary as well as contributory cause) i.e. coma as a result of head injury contributed by shock and haemorrhage due to multiple incised and lacerated wounds described and noted during autopsy of this particular case. Conclusion: To identify repeat offenders and for easy identification of the culprit, criminal database (fingerprints, DNA database, dental charting along-with any implant in oral cavity, dental images and biometrics) should be prepared and preserved for future reference. © 2018, Punjab Academy of Forensic Medicine and Toxicology.
